1. Purpose and acceptance

These Terms of Use (the "Terms") govern the use of the SublimeTV application (the "Application") and its associated service (the "Service"), published by Arnaud Royo, operating the application as an individual (no company), in Antibes (06169), France, reachable at contact@sublimetv.app (the "Publisher").

By creating an account or using the Application, you accept these Terms in full. If you do not accept them, do not use the Application.

2. Description of the Service

SublimeTV is a media player and management client for IPTV services compatible with Xtream Codes and for M3U playlists that you supply yourself. The Application:

The Publisher does not provide, host, distribute or resell any audiovisual content or any IPTV subscription. On installation, the Application is empty: it contains no channel, no link and no playlist until you have configured your own provider. The video stream is played directly from your provider and does not pass through the Publisher's servers.

By configuring a provider, you confirm that you have lawful access to the corresponding service. The Publisher has no control over the content served by your provider, does not review it and accepts no responsibility for it.

The Publisher reserves the right to refuse support and to disengage from any manifestly unlawful use, without this amounting to any acknowledgement of liability.

The processing of your data is described in the Privacy Policy, which forms an integral part of these Terms. You can delete your account at any time (Settings → Account → "Delete account", or from the Delete my account page).

8. Premium (paid account)

The Service can be used free of charge. A paid Premium tier unlocks additional features (multiple profiles, offline downloads, Cast and send to TV). Premium gives access to no audiovisual content: it changes only the features of the Application, the content still being supplied by your own provider.

9. Availability and disclaimer of warranty

10. Limitation of liability

To the extent permitted by law, the Publisher shall not be held liable for indirect damages, loss of data, harm resulting from the unavailability of the Service, or the consequences of your use of third-party providers. These Terms do not limit the mandatory rights you enjoy as a consumer.

These Terms may be updated. The last-updated date appears at the top of the document; substantial changes will be notified within the Application. Continued use after notification constitutes acceptance of the amended Terms.

13. Governing law and jurisdiction

These Terms are governed by French law, without prejudice to the more protective mandatory provisions of the consumer's country of habitual residence.

No court is designated in advance: under consumer law, a consumer may bring proceedings either before the court of their place of residence or before that of the Publisher's place of residence. A jurisdiction clause imposed on a consumer would be deemed unwritten, which is why these Terms contain none.

Before taking any action, you may send a complaint to contact@sublimetv.app. Failing resolution, you may use a consumer mediator free of charge, as well as the European online dispute resolution platform.
