1. Purpose and acceptance

These Terms of Use (the "Terms") govern the use of the SublimeTV application (the "Application") and its associated service (the "Service"), published by Arnaud Royo, operating the application as an individual (no company), in Antibes (06169), France, reachable at contact@sublimetv.app (the "Publisher").

By creating an account or using the Application, you accept these Terms in full. If you do not accept them, do not use the Application.

2. Description of the Service

SublimeTV is a media player and management client for IPTV services compatible with Xtream Codes and for M3U playlists that you supply yourself. The Application:

• lets you enter your own credentials for an IPTV subscription taken out with a third party, independent of the Publisher;
• plays the streams exposed by the portal you configure;
• enriches the display (posters, summaries, cast) using public TMDB metadata, for purely cosmetic and navigation purposes;
• manages a SublimeTV account (profiles, favourites, history, preferences) to synchronise your experience across your devices.

The Publisher does not provide, host, distribute or resell any audiovisual content or any IPTV subscription. On installation, the Application is empty: it contains no channel, no link and no playlist until you have configured your own provider. The video stream is played directly from your provider and does not pass through the Publisher's servers.

3. Account and eligibility

• A SublimeTV account is required to use the Application.
• You are responsible for the accuracy of the information you provide, for keeping your password confidential, and for all activity carried out from your account.
• The Service is reserved for adults (18 years or older). The Application is not intended for minors and is not offered to them. By creating an account, you declare that you are 18 or older.

4. Your responsibility for content

The Application is a neutral tool. You are solely responsible for:

• the legality of the IPTV subscription or playlist you configure in the Application;
• compliance with intellectual property rights and any rights attached to the content you access;
• the compliance of your use with the laws and regulations applicable in your country.

By configuring a provider, you confirm that you have lawful access to the corresponding service. The Publisher has no control over the content served by your provider, does not review it and accepts no responsibility for it.

5. Prohibited uses

You must not use the Application or the Service to:

• access content or services for which you do not hold the rights or lawful access;
• circumvent a technical protection measure, geoblocking or access restriction;
• infringe the rights of third parties (intellectual property, privacy, image rights);
• disrupt, overload or attempt to compromise the security of the Service (reverse engineering for malicious purposes, unauthorised access, circumvention of technical limits, abusive automation);
• resell, sublicense or commercially exploit the Application without the Publisher's written permission.

The Publisher reserves the right to refuse support and to disengage from any manifestly unlawful use, without this amounting to any acknowledgement of liability.

6. Intellectual property

• The Application (code, interface, the "SublimeTV" trademark, graphic elements) is protected and remains the property of the Publisher. These Terms grant you a personal, non-exclusive, non-transferable and revocable right of use, limited to the normal operation of the Application.
• Metadata and illustration artwork come from TMDB. This product uses the TMDB API but is not endorsed or certified by TMDB. Rights in those elements remain with their respective holders.
• Content served by your provider belongs to its respective rights holders; the Publisher grants you no rights over that content.

7. Personal data

The processing of your data is described in the Privacy Policy, which forms an integral part of these Terms. You can delete your account at any time (Settings → Account → "Delete account", or from the Delete my account page).

8. Premium (paid account)

The Service can be used free of charge. A paid Premium tier unlocks additional features (multiple profiles, offline downloads, Cast and send to TV). Premium gives access to no audiovisual content: it changes only the features of the Application, the content still being supplied by your own provider.

• Plans. Two plans are offered: an annual subscription with automatic renewal, and a one-off lifetime purchase with no renewal. Applicable amounts are displayed in the Application before any payment, in the currency and with the taxes of your country; the amounts shown on the payment screen are the ones that apply.
• Payment method. Payment is processed by a provider depending on where your installation came from: Google Play for an application installed from the Play Store, or Stripe through your browser otherwise. That provider's terms apply in addition to these.
• Renewal and cancellation. The annual subscription renews automatically at term unless cancelled beforehand. You may cancel at any time, free of charge and without reason, from the Application ("Manage my subscription") or from your Google Play account depending on the payment method used. Cancellation takes effect at the end of the period already paid for, which remains due and usable.
• Right of withdrawal. You have 14 days to withdraw from a distance purchase. However, since access to Premium features is enabled immediately, you expressly request that immediate performance and acknowledge that you lose your right of withdrawal once the service has been fully performed. For a purchase made through Google Play, Google's refund policy also applies.
• Suspension of sales. The Publisher may suspend sales at any time. A suspension does not affect rights already acquired: an account that is already Premium remains so until its rights expire.
• No content guarantee. Premium guarantees neither the availability, nor the quality, nor the legality of your provider's streams, which remain outside the Publisher's control.

9. Availability and disclaimer of warranty

• The Service is provided "as is" and "as available", with no guarantee of uninterrupted or error-free operation, nor of compatibility with any particular IPTV provider.
• The quality, availability and continuity of the streams depend on your provider and your connection, outside the Publisher's control.
• The Publisher may change, suspend or discontinue all or part of the Service, in particular for technical, security or product reasons.

10. Limitation of liability

To the extent permitted by law, the Publisher shall not be held liable for indirect damages, loss of data, harm resulting from the unavailability of the Service, or the consequences of your use of third-party providers. These Terms do not limit the mandatory rights you enjoy as a consumer.

11. Suspension and termination

• You may stop using the Service and delete your account at any time.
• The Publisher may suspend or terminate access in the event of a breach of these Terms, in particular unlawful use or an attack on the security of the Service.

12. Changes to the Terms

These Terms may be updated. The last-updated date appears at the top of the document; substantial changes will be notified within the Application. Continued use after notification constitutes acceptance of the amended Terms.

13. Governing law and jurisdiction

These Terms are governed by French law, without prejudice to the more protective mandatory provisions of the consumer's country of habitual residence.

No court is designated in advance: under consumer law, a consumer may bring proceedings either before the court of their place of residence or before that of the Publisher's place of residence. A jurisdiction clause imposed on a consumer would be deemed unwritten, which is why these Terms contain none.

Before taking any action, you may send a complaint to contact@sublimetv.app. Failing resolution, you may use a consumer mediator free of charge, as well as the European online dispute resolution platform.
